However, we cannot avoid the legal aspect, to prevent misunderstandings or guard against misuse.<\/strong><\/p>

  • Booking and payment are done online. A booking is only confirmed after successful payment.<\/li>
  • You can move or cancel a session free of charge up to 24 hours before it begins.<\/li>

  • A standalone session is a booking for a specific date and time. To the extent permitted by law, there is no statutory right of withdrawal from this.<\/li>
  • A studio season ticket or a strip ticket has a statutory cooling-off period of 14 days for consumers, except for hours that have already been used or booked.<\/li>
  • The access code or digital key is personal. Do not share it with anyone outside of your booking.<\/li>
  • You are responsible for yourself, your guests, and the correct closing of the space.<\/li>
  • If you do not leave the space as you found it, cleaning or repair charges may apply.<\/li>
  • Food and drink are not permitted in the Record Room, except for water in a sealed bottle.<\/li>
  • Smoking, vaping, drugs and open fires are prohibited and may lead to termination, a fine and recharged demonstrable damages.<\/li>
  • Your recordings are yours. Record Room does not use your recordings for its own purposes.<\/li>
  • Recordings are made temporarily available and then automatically deleted. Record Room is not a backup service.<\/li>
  • CCTV may be present in and around the Record Room for safety, access control and incident investigation.<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    2. Definitions<\/h2>\t\t\t\t<\/div>\n\t\t\t\t

    In these terms and conditions, we mean by:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t\t\t\t\t

    Hall of Records<\/strong>\u00a0Sole proprietorship trading under the business name Record Room, located at Vrijheidsplantsoen 6, 1447XZ Purmerend, registered with the Chamber of Commerce under number 96005599, with VAT number NL001350587B54.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t\t\t\t\t

    User:<\/strong> every natural or legal person who books a session, purchases studio credit, creates an account or uses the Record Room.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t\t\t\t\t

    Consumer<\/strong> a natural person acting for purposes outside their trade or profession.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t\t\t\t\t

    Business user<\/strong> a user acting in the course of a profession, business, organisation or enterprise.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t\t\t\t\t

    Session<\/strong> the period for which the user has booked the Record Room, including entering, using and correctly vacating the space.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t\t\t\t\t

    Record Room \/ space \/ studio:<\/strong> the autonomous recording facility, including equipment, furniture, software, access systems, tablet, cameras, microphones, lighting, network services and other inventory.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t\t\t\t\t

    Studio balance:<\/strong> pre-purchased recording time, for example via a Creator Pack, Pro Pack, punch card or other hour package.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t\t\t\t\t

    Booking:<\/strong> a reservation for a concrete session on a specific date, start time, end time, and location.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t\t\t\t\t

    Guests<\/strong> all persons carried, admitted or involved in the session by or on behalf of the user, whether physically or remotely.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t\t\t\t\t

    Recordings<\/strong> all audio, video, image and data files created during or as a result of a session, including raw recordings, automatic edits, exports, thumbnails and derivative files.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t\t\t\t\t

    Platform<\/strong> the website, booking environment, user account, payment environment, and any software or apps with which Record Room offers its services.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    3. Applicability and agreement<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t

    3.1 Application<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    These terms and conditions apply to every offer, booking, purchase of studio credit, access to and use of the Record Room.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    3.2 Available in advance<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    Record Room shall make these terms and conditions available prior to the conclusion of the agreement in a manner that allows the user to read, save, and download them.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    3.3 Agreement upon booking or purchase<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    By placing a booking, purchasing studio credit, creating an account, or using the Record Room, the user agrees to these terms.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    3.4 Consumer Rights<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    If the user is a consumer, these terms and conditions do not affect any rights that the consumer has under mandatory consumer law. If any provision of these terms and conditions conflicts with mandatory consumer law, that provision shall not apply to the extent necessary.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    3.5 Deviating agreements<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    Deviating agreements only apply if they have been confirmed in writing or by e-mail by Record Room.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    4. Booking, rescheduling and cancelling<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t

    4.1 Booking<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    A booking is confirmed once payment has been successfully completed and Record Room has confirmed the booking. The user will receive booking information via email or their account, and where applicable, a unique access code or digital key.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    4.2 Date, time and location<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    A booking is exclusively valid for the selected date, start time, end time, duration, and location. The access code or digital key will only work within the reserved time slot and exclusively for the relevant location.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    4.3 Moving or cancelling<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    Up to 24 hours before the start of the session, the user can move or cancel the booking free of charge via their account or through the procedure indicated by Record Room.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t\t\t\t\t

    After this period, the booked time is confirmed. Refunds are then not possible, unless Record Room decides otherwise or mandatory law dictates otherwise.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    4.4 Late arrival<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    The session starts from the original start time. The end time does not shift if the user arrives later.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    4.5 Did not attend<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    If the user does not show up within the booked time slot, the full session fee will be charged. If the session has been paid for with studio credit, the booked hours will be deducted from the studio credit.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    4.6 Extension<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    An extension of a session is only possible if the room is available and the extension is confirmed and paid for via the platform, tablet, or another method offered by Record Room.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    4.7 Cancellation by Record Room<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    Record Room may cancel or reschedule a booking if the space is unavailable due to technical failure, damage, emergency, safety risk, force majeure, or any other significant reason. In such cases, Record Room shall, where reasonably possible, offer a replacement session or refund the paid session fee.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    5. Consumer's right of withdrawal<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t

    5.1 Date-bound sessions<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    A standalone session is a reservation for a specific date, start time, duration, and location. This date-bound reservation, to the extent permitted by law, does not have a statutory right of withdrawal. Cancellation or rescheduling is possible in accordance with Article 4.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    5.2 Studio balance \/ credit cards<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    If the user is a consumer, upon purchase of studio credit, there is a statutory cooling-off period of 14 days from the day of purchase, unless the studio credit has been fully used within this period with the express prior consent of the consumer.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    5.3 Use during the reflection period<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    If a consumer wishes to use studio-saldo within the reflection period, they give Record Room permission to start the service immediately. If the service is revoked within the reflection period, any hours already used, date-specific sessions booked, and services already provided will be settled on a pro rata basis against the amount to be refunded.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    5.4 No right of withdrawal for business users<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    There is no statutory right of withdrawal for business users.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    6. Access and locking<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t

    6.1 Access code or digital key<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    For each session, the user will receive a personal access code, digital key, or other access provision. This is strictly personal and must not be shared with individuals not included in the booking.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    6.2 Careful use<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    Users must handle access codes, digital keys, account details and other access credentials with care. Any suspected loss, theft or misuse must be reported to Record Room as soon as possible.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    6.3 Responsibility for guests<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    The user is responsible for all guests they bring, invite, grant access to, or allow to participate during their session. The user shall ensure that their guests comply with these terms and the house rules.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    6.4 Maximum number of people<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    A maximum of 4 people may be present in the Record Room at the same time, unless a lower maximum is stated in the booking, on location, or in the instructions. Additional participants can join remotely if available via the remote or livestream function.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    6.5 Checkout Procedure<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    After the session, the user is required to leave the Record Room tidy and correctly lock it according to the check-out procedure on the tablet, in the platform, or according to on-site instructions.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t\t\t\t\t

    The locking is only complete when clear confirmation is visible and the door is properly secured.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    6.6 Incorrect locking<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    If the user does not lock the space correctly, the user shall be liable for damage, loss, theft, or misuse that is reasonably attributable to the failure to lock correctly, unless the user proves that the damage would also have occurred if the space had been locked correctly.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    6.7 Misuse of access<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    Misuse of an access code, digital key or account by persons to whom the user has provided or shown this information is at the user's own risk.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    7. Use of space<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t

    7.1 Normal Use<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    The user shall use the Record Room carefully, safely, and exclusively for its intended purpose: recording, streaming, or producing audio, video, podcast, social media, webinar, or similar content.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    7.2 Instructions<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    The user follows the instructions on the tablet, in the room, in the confirmation email, on the platform, and from any Record Room staff or location managers.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    7.3 House Rules of the Location<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    In addition to these terms and conditions, the user must also comply with the house rules applicable at the location, insofar as these have been made known in advance or on site. In case of conflict between the house rules and these terms and conditions, these terms and conditions shall prevail, unless the house rules relate to safety, access, building management or regulations of the location.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    7.4 No technical adjustments<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    It is not permitted to move, disconnect, modify or remove equipment, wiring, cameras, microphones, lighting, network facilities, software, settings or mounting profiles, unless Record Room expressly permits it or the instructions indicate so.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    7.5 Own Equipment<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    Users may bring their own equipment provided it fits within the normal and safe use of the space. Users' own equipment remains entirely at their own risk. Record Room is not responsible for the compatibility, malfunction, loss, or damage of users' own equipment, unless circumstances arise for which Record Room is liable under mandatory law.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    7.6 Food and Drink<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    Food and drink are not permitted in the Record Room, with the exception of water in a sealed bottle. The Record Room may reclaim damage or cleaning costs from the user for breaching this rule.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t

    7.7 Smoking, vaping, drugs and open fires<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
    \n\t\t\t\t\t\t\t\t\t

    Smoking, vaping, the use or possession of drugs, and the lighting of open fires, including candles, are prohibited in and around the Record Room.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t\t\t\t\t

    In case of breach, Record Room is entitled to:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

    \n\t\t\t\t\t\t\t\t\t
    1. to terminate the session immediately without refund;<\/li>
    2. to charge an immediately payable contractual penalty of \u20ac500 per breach;<\/li>
    3. reclaim demonstrable actual damage provided that damage exceeds the penalty;<\/li>
    4. cancel current or future bookings;<\/li>
    5. to temporarily or permanently exclude the user from the platform.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t
      \n\t\t\t\t\t\t\t\t\t

      Actual damage includes reasonable cleaning, repair, and replacement costs, as well as demonstrable loss of revenue during the period the space is reasonably unusable for rental.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

      \n\t\t\t\t\t

      7.8 Behaviour<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
      \n\t\t\t\t\t\t\t\t\t

      The user and their guests shall behave in a neat, safe, and respectful manner towards other visitors, employees, venue managers, and local residents. Record Room reserves the right to deny access or terminate a session in cases of misconduct, intoxication, harassment, nuisance, aggression, vandalism, dangerous behaviour, or behaviour that endangers the property or safety of others.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

      \n\t\t\t\t\t

      7.9 Leave clean and tidy<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
      \n\t\t\t\t\t\t\t\t\t

      The user leaves the space as they found it: cables and accessories in place, chairs tidy, no rubbish, no personal belongings, and no mess.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

      \n\t\t\t\t\t\t\t\t\t

      In the event of severe contamination, Record Room reserves the right to charge reasonable cleaning costs. If professional cleaning is necessary, there will be a minimum charge of \u20ac250. Record Room will provide reasonable substantiation of costs upon request.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

      \n\t\t\t\t\t

      7.10 Lost property<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
      \n\t\t\t\t\t\t\t\t\t

      The Record Room stores found personal items for a maximum of 30 days. After this period, the Record Room may dispose of these items by removal, donation, or destruction, unless otherwise stipulated by law. Shipping or delivery of abandoned items will only occur after consultation and at the user's expense and risk.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

      \n\t\t\t\t\t

      8. Damage and user liability<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
      \n\t\t\t\t\t

      8.1 Liability during the session<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
      \n\t\t\t\t\t\t\t\t\t

      The user is liable for damage to, loss of, or theft of equipment, inventory, software, access tokens, or the Record Room itself, to the extent that such damage is attributable to the user, their guests, or their use of the premises.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

      \n\t\t\t\t\t

      8.2 Damage by Guests<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
      \n\t\t\t\t\t\t\t\t\t

      Damage caused by the user's guests is the responsibility of the user, in so far as this damage can be attributed to the user, for example because the user brought these.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

      \n\t\t\t\t\t

      8.3 Third parties entering<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
      \n\t\t\t\t\t\t\t\t\t

      If third parties enter during the session without the user's permission, the user shall only be liable for damage caused by these third parties if this is reasonably related to the user's action or inaction, such as sharing an access code, leaving the door unlocked, or failing to follow the logout procedure.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

      \n\t\t\t\t\t

      What is included in a session is determined by the product description, booking page, quotation, or confirmation. This may include, for example, studio access, use of equipment, automatic recording, automatic editing, live streaming functionality, cloud delivery, or additional services.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

      9.3 Test Intake<\/h3>\t\t\t\t<\/div>\n\t\t\t\t

      At the beginning of the session, the user must make a short test recording and check the image, sound, framing, lighting, microphone distance and settings. If the user proceeds without a test recording, defects that would have been visible or audible during a reasonable test will be the user's responsibility, unless there is a demonstrable technical failure of Record Room systems.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

      9.4 Technical fault due to Record Room<\/h3>\t\t\t\t<\/div>\n\t\t\t\t

      If a usable recording cannot be made due to a demonstrable technical failure of Record Room's equipment, software or systems, Record Room will offer, at its discretion, a free replacement session or a refund of the paid session fee.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

      This does not apply if the failure has been caused by:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

      2. failure to follow instructions;<\/li>
      3. the user's own equipment, software, accounts, or platforms;<\/li>

      5. internet, power, building, or environmental failures beyond the reasonable control of Record Room;<\/li>
      6. circumstances that were visible or audible during a reasonable test recording and were not reported in a timely manner.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t
        \n\t\t\t\t\t

        9.5 Automated assembly and delivery<\/h3>\t\t\t\t<\/div>\n\t\t\t\t

        If automatic assembly or delivery by email is part of the product, Record Room will endeavour to make the recording available as quickly as possible. The stated delivery times, such as \u201csame day\u201d or \u201cimmediately after your session\u201d, are target deadlines unless expressly agreed otherwise in writing.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

        Complaints regarding the technical quality of the recording must be reported within 48 hours of the recording becoming available, with a clear description of the problem. Record Room shall be given the opportunity to investigate and, where reasonably possible, rectify the problem.         11.2 Use by Record Room<\/h3>\t\t\t\t<\/div>\n\t\t\t\t

        Record Room does not use recordings for its own marketing, portfolio, training, sales or other proprietary purposes, unless the user gives express prior consent.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

        11.3 Access to recordings by the Record Room<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
        \n\t\t\t\t\t\t\t\t\t

        Record Room views or listens to recordings exclusively in the following cases:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

        1. when the user explicitly requests it, for example for assembly, support or quality control;<\/li>
        2. in the case of a concrete and documented suspicion of damage, theft, vandalism, serious breach of these conditions, or other unlawful use, strictly to the extent necessary for the investigation of that specific event;<\/li>
        3. if this is necessary for technical support or the resolution of a fault, to the extent that the user requests it or it is reasonably necessary;<\/li>
        4. on lawful claim by a competent authority.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t
          \n\t\t\t\t\t\t\t\t\t

          Access to recordings is restricted to what is necessary and is logged internally where reasonably possible.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

          11.4 Retention Period for Recordings<\/h3>\t\t\t\t<\/div>\n\t\t\t\t

          Record Room is not a backup service. Users are responsible for downloading, checking, saving, backing up and securing their recordings in a timely manner.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

          11.6 Third-party rights<\/h3>\t\t\t\t<\/div>\n\t\t\t\t

          The user is solely responsible for all rights and permissions required for their recording, including permission from guests, speakers, employees, customers, or any other individuals appearing in the recording.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

          The user is solely responsible for ensuring compliance with copyright, portrait rights, trademark law, privacy legislation, contractual agreements and third-party platform terms and conditions.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

          \n\t\t\t\t\t

          11.7 Licences for supplied content<\/h3>\t\t\t\t<\/div>\n\t\t\t\t

          If the user provides logos, music, images, videos, presentations, fonts or other materials, the user guarantees that they are authorised to use and process these materials in the recording or editing.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

          12. Prohibited Content and Prohibited Use<\/h2>\t\t\t\t<\/div>\n\t\t\t\t

          6. content that is manifestly unlawful;<\/li>
          7. Activities that could cause damage to the Record Room, the location, third parties, or the reputation of the parties involved.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t
            \n\t\t\t\t\t

            12.2 Professional character<\/h3>\t\t\t\t<\/div>\n\t\t\t\t

            Record Room is intended for professional, business, educational, informational, creative, and commercial content production. Record Room may refuse or terminate use if the intended use does not reasonably fit within this character.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

            12.3 Measures for infringement<\/h3>\t\t\t\t<\/div>\n\t\t\t\t

            Security cameras do not record audio by default, unless this is expressly stated and there is a valid legal basis for it. This does not affect the fact that the user themselves records audio and video via Record Room's recording facilities.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

            \n\t\t\t\t\t

            13.3 Retention period of camera footage<\/h3>\t\t\t\t<\/div>\n\t\t\t\t

            CCTV footage is stored for a maximum of 28 days, unless an incident, investigation, claim, legal proceeding or lawful request from an authorised body occurs.             This includes, but is not limited to, power outages, internet outages, fire, water damage, building malfunctions, government measures, outages on external platforms, outages with suppliers, security incidents, on-site emergencies, extreme weather conditions, strikes or other circumstances that Record Room cannot reasonably prevent.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

            16.2 Consequences of force majeure<\/h3>\t\t\t\t<\/div>\n\t\t\t\t

            In case of force majeure, Record Room will, where reasonably possible, offer a replacement session. If replacement is not reasonably possible, Record Room may refund the amount paid for the session.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

            \n\t\t\t\t\t

            17. Changes to these terms<\/h2>\t\t\t\t<\/div>\n\t\t\t\t
            \n\t\t\t\t\t

            17.1 Right to modify<\/h3>\t\t\t\t<\/div>\n\t\t\t\t
            \n\t\t\t\t\t\t\t\t\t

            Record Room may change these terms and conditions from time to time, for example, due to legislation or regulation, changes in service provision, new features, security measures, privacy requirements, or operational adjustments.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

            17.2 Announcement<\/h3>\t\t\t\t<\/div>\n\t\t\t\t

            Substantial changes will be announced at least 30 days before they come into effect via e-mail, the platform or the user's account, unless an earlier change is necessary due to legislation, safety, abuse prevention or urgent operational reasons.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

            17.3 Existing Bookings<\/h3>\t\t\t\t<\/div>\n\t\t\t\t

            Substantial changes do not apply to bookings already confirmed, unless the change is necessary due to legislation, safety, abuse prevention, or operational necessity.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

            17.4 Studio balance with unfavourable change<\/h3>\t\t\t\t<\/div>\n\t\t\t\t

            In the event of material adverse changes to an existing studio balance, the user will be given the opportunity to use the remaining balance within a reasonable timeframe. If this is not reasonably possible, Record Room may refund the unused portion on a pro-rata basis.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

            18. Complaints and support<\/h2>\t\t\t\t<\/div>\n\t\t\t\t

            Complaints can be submitted via info@recordroom.nl or via the contact method stated on the website or in the account.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

            18.2 Response time<\/h3>\t\t\t\t<\/div>\n\t\t\t\t

            Record Room will respond to complaints within 5 working days and aims to resolve complaints as quickly as possible and in good consultation.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

            18.3 Failures during session<\/h3>\t\t\t\t<\/div>\n\t\t\t\t

            Failures during a session must be reported as quickly as possible via the tablet, help button, chat, phone number, or other support method offered by Record Room. If a failure is not reported during the session, it may affect the ability to diagnose or rectify the problem.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t

            Disputes that are not resolved by mutual agreement shall be submitted to the competent court in the district of Amsterdam, insofar as this is legally permissible.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t
