We're doing our best to create something beautiful – and we hope all our guests will help us with that.
However, we cannot avoid the legal aspect, to prevent misunderstandings or guard against misuse.
Please read the summary carefully and, where necessary, read further. We hope everyone enjoys the Record Room.
By booking a session, purchasing studio credit, or using the Record Room, you agree to these terms and conditions.
For those who want to know the gist quickly:

Studio balance: pre-purchased recording time, for example via a Creator Pack, Pro Pack, punch card or other hour package.

Platform the website, booking environment, user account, payment environment, and any software or apps with which Record Room offers its services.
These terms and conditions apply to every offer, booking, purchase of studio credit, access to and use of the Record Room.
Record Room shall make these terms and conditions available prior to the conclusion of the agreement in a manner that allows the user to read, save, and download them.
By placing a booking, purchasing studio credit, creating an account, or using the Record Room, the user agrees to these terms.
If the user is a consumer, these terms and conditions do not affect any rights that the consumer has under mandatory consumer law. If any provision of these terms and conditions conflicts with mandatory consumer law, that provision shall not apply to the extent necessary.
Deviating agreements only apply if they have been confirmed in writing or by e-mail by Record Room.
A booking is confirmed once payment has been successfully completed and Record Room has confirmed the booking. The user will receive booking information via email or their account, and where applicable, a unique access code or digital key.
A booking is exclusively valid for the selected date, start time, end time, duration, and location. The access code or digital key will only work within the reserved time slot and exclusively for the relevant location.
Up to 24 hours before the start of the session, the user can move or cancel the booking free of charge via their account or through the procedure indicated by Record Room.
After this period, the booked time is confirmed. Refunds are then not possible, unless Record Room decides otherwise or mandatory law dictates otherwise.
The session starts from the original start time. The end time does not shift if the user arrives later.
If the user does not show up within the booked time slot, the full session fee will be charged. If the session has been paid for with studio credit, the booked hours will be deducted from the studio credit.
An extension of a session is only possible if the room is available and the extension is confirmed and paid for via the platform, tablet, or another method offered by Record Room.
Record Room may cancel or reschedule a booking if the space is unavailable due to technical failure, damage, emergency, safety risk, force majeure, or any other significant reason. In such cases, Record Room shall, where reasonably possible, offer a replacement session or refund the paid session fee.
A standalone session is a reservation for a specific date, start time, duration, and location. This date-bound reservation, to the extent permitted by law, does not have a statutory right of withdrawal. Cancellation or rescheduling is possible in accordance with Article 4.
If the user is a consumer, upon purchase of studio credit, there is a statutory cooling-off period of 14 days from the day of purchase, unless the studio credit has been fully used within this period with the express prior consent of the consumer.
If a consumer wishes to use studio-saldo within the reflection period, they give Record Room permission to start the service immediately. If the service is revoked within the reflection period, any hours already used, date-specific sessions booked, and services already provided will be settled on a pro rata basis against the amount to be refunded.
There is no statutory right of withdrawal for business users.
For each session, the user will receive a personal access code, digital key, or other access provision. This is strictly personal and must not be shared with individuals not included in the booking.
Users must handle access codes, digital keys, account details and other access credentials with care. Any suspected loss, theft or misuse must be reported to Record Room as soon as possible.
The user is responsible for all guests they bring, invite, grant access to, or allow to participate during their session. The user shall ensure that their guests comply with these terms and the house rules.
A maximum of 4 people may be present in the Record Room at the same time, unless a lower maximum is stated in the booking, on location, or in the instructions. Additional participants can join remotely if available via the remote or livestream function.
After the session, the user is required to leave the Record Room tidy and correctly lock it according to the check-out procedure on the tablet, in the platform, or according to on-site instructions.
The locking is only complete when clear confirmation is visible and the door is properly secured.
If the user does not lock the space correctly, the user shall be liable for damage, loss, theft, or misuse that is reasonably attributable to the failure to lock correctly, unless the user proves that the damage would also have occurred if the space had been locked correctly.
Misuse of an access code, digital key or account by persons to whom the user has provided or shown this information is at the user's own risk.
The user shall use the Record Room carefully, safely, and exclusively for its intended purpose: recording, streaming, or producing audio, video, podcast, social media, webinar, or similar content.
The user follows the instructions on the tablet, in the room, in the confirmation email, on the platform, and from any Record Room staff or location managers.
In addition to these terms and conditions, the user must also comply with the house rules applicable at the location, insofar as these have been made known in advance or on site. In case of conflict between the house rules and these terms and conditions, these terms and conditions shall prevail, unless the house rules relate to safety, access, building management or regulations of the location.
It is not permitted to move, disconnect, modify or remove equipment, wiring, cameras, microphones, lighting, network facilities, software, settings or mounting profiles, unless Record Room expressly permits it or the instructions indicate so.
Users may bring their own equipment provided it fits within the normal and safe use of the space. Users' own equipment remains entirely at their own risk. Record Room is not responsible for the compatibility, malfunction, loss, or damage of users' own equipment, unless circumstances arise for which Record Room is liable under mandatory law.
Food and drink are not permitted in the Record Room, with the exception of water in a sealed bottle. The Record Room may reclaim damage or cleaning costs from the user for breaching this rule.
Smoking, vaping, the use or possession of drugs, and the lighting of open fires, including candles, are prohibited in and around the Record Room.
In case of breach, Record Room is entitled to:
Actual damage includes reasonable cleaning, repair, and replacement costs, as well as demonstrable loss of revenue during the period the space is reasonably unusable for rental.
The user and their guests shall behave in a neat, safe, and respectful manner towards other visitors, employees, venue managers, and local residents. Record Room reserves the right to deny access or terminate a session in cases of misconduct, intoxication, harassment, nuisance, aggression, vandalism, dangerous behaviour, or behaviour that endangers the property or safety of others.
The user leaves the space as they found it: cables and accessories in place, chairs tidy, no rubbish, no personal belongings, and no mess.
In the event of severe contamination, Record Room reserves the right to charge reasonable cleaning costs. If professional cleaning is necessary, there will be a minimum charge of €250. Record Room will provide reasonable substantiation of costs upon request.
The Record Room stores found personal items for a maximum of 30 days. After this period, the Record Room may dispose of these items by removal, donation, or destruction, unless otherwise stipulated by law. Shipping or delivery of abandoned items will only occur after consultation and at the user's expense and risk.
The user is liable for damage to, loss of, or theft of equipment, inventory, software, access tokens, or the Record Room itself, to the extent that such damage is attributable to the user, their guests, or their use of the premises.
Damage caused by the user's guests is the responsibility of the user, in so far as this damage can be attributed to the user, for example because the user brought these.
If third parties enter during the session without the user's permission, the user shall only be liable for damage caused by these third parties if this is reasonably related to the user's action or inaction, such as sharing an access code, leaving the door unlocked, or failing to follow the logout procedure.
If the user notices any existing damage, defects, malfunctions, pollution or missing items at the start of the session, they must report this within 10 minutes of the start time via the tablet, platform, help button or emergency number.
If the user does not report this in a timely manner, the Record Room may assume that the space was in good condition at the start, unless the user can credibly demonstrate that the damage or defect was already present.
Damage is determined based on reasonable repair, cleaning, or replacement costs. If the space is temporarily unusable due to damage, Record Room may charge for demonstrable loss of revenue for the period the space was reasonably unavailable.
Record Room provides a specified justification before damage is definitively settled or invoiced.
The user indemnifies Record Room against third-party claims arising from the user's or their guests' use of the Record Room, including claims relating to content, privacy, image rights, copyright, trademark rights, contractual obligations, damage, or tort, to the extent that these claims can be attributed to the user.
Record Room advises users to have appropriate liability, business, or production insurance, especially for professional use, paying guests, commercial productions, or the use of personal equipment.
Record Room endeavours to provide a well-functioning, safe, and reliable recording environment. The space is set up for accessible use, but Record Room does not guarantee that every recording will be technically, creatively, or substantively perfect.
What is included in a session is determined by the product description, booking page, quotation, or confirmation. This may include, for example, studio access, use of equipment, automatic recording, automatic editing, live streaming functionality, cloud delivery, or additional services.
At the beginning of the session, the user must make a short test recording and check the image, sound, framing, lighting, microphone distance and settings. If the user proceeds without a test recording, defects that would have been visible or audible during a reasonable test will be the user's responsibility, unless there is a demonstrable technical failure of Record Room systems.
If a usable recording cannot be made due to a demonstrable technical failure of Record Room's equipment, software or systems, Record Room will offer, at its discretion, a free replacement session or a refund of the paid session fee.
This does not apply if the failure has been caused by:
If automatic assembly or delivery by email is part of the product, Record Room will endeavour to make the recording available as quickly as possible. The stated delivery times, such as “same day” or “immediately after your session”, are target deadlines unless expressly agreed otherwise in writing.
Record Room is not liable for the user's creative or content choices, including text, presentation, attitude, clothing, misspeaking, hairstyle, substantive errors, insufficient preparation, or dissatisfaction with one's own performance.
Complaints regarding the technical quality of the recording must be reported within 48 hours of the recording becoming available, with a clear description of the problem. Record Room shall be given the opportunity to investigate and, where reasonably possible, rectify the problem. This provision does not affect mandatory consumer rights.
Record Room's liability, to the extent permitted by law, is limited to the amount paid by the user for the relevant session, or the offering of an equivalent replacement session.
This limitation does not apply in cases of wilful misconduct or gross negligence by Record Room, or to the extent that limitation of liability is not permitted by mandatory law.
Record Room is not liable, to the extent permitted by law, for indirect or consequential damages, including lost revenue, missed assignments, missed deadlines, reputational damage, loss of customers, loss of data, loss of goodwill, costs of replacement production, or damages due to errors in the recording content.
Record Room shall not be liable for any disruptions or failed recordings due to factors beyond its reasonable sphere of influence, including ambient noise, renovations in or near the premises, power outages, internet outages, failures of external platforms, conduct of persons outside of Record Room, or directions from the venue manager.
The user remains solely responsible for preparation, planning, content, sufficient allocated time, test recordings, checking the recording, and downloading and saving files in a timely manner.
All recordings made by the user during their session are and remain the property of the user or their client. Record Room obtains no ownership rights to the content of the recording.
Record Room does not use recordings for its own marketing, portfolio, training, sales or other proprietary purposes, unless the user gives express prior consent.
Record Room views or listens to recordings exclusively in the following cases:
Access to recordings is restricted to what is necessary and is logged internally where reasonably possible.
Recordings are made temporarily available in the cloud environment or via a download link from Record Room. The retention period is 7 days from the moment the recording is made available to the user, unless otherwise agreed in writing.
After this term, recordings may be automatically and permanently deleted. Record Room is not obliged to restore deleted recordings.
Record Room is not a backup service. Users are responsible for downloading, checking, saving, backing up and securing their recordings in a timely manner.
The user is solely responsible for all rights and permissions required for their recording, including permission from guests, speakers, employees, customers, or any other individuals appearing in the recording.
The user is solely responsible for ensuring compliance with copyright, portrait rights, trademark law, privacy legislation, contractual agreements and third-party platform terms and conditions.
If the user provides logos, music, images, videos, presentations, fonts or other materials, the user guarantees that they are authorised to use and process these materials in the recording or editing.
It is not permitted to use the Record Room for:
Record Room is intended for professional, business, educational, informational, creative, and commercial content production. Record Room may refuse or terminate use if the intended use does not reasonably fit within this character.
In the event of a breach of this article, Record Room may immediately terminate the session, cancel ongoing bookings, block access, secure recordings as necessary, file a report, or take any other appropriate action.
In that case, a refund is not obligatory, unless mandatory law stipulates otherwise.
CCTV may be present in and around the Record Room for security, access control, prevention of damage and theft, incident support, and investigation into breaches of these terms.
These camera images are separate from the audio and video recordings that the user makes themselves during their session.
Security cameras do not record audio by default, unless this is expressly stated and there is a valid legal basis for it. This does not affect the fact that the user themselves records audio and video via Record Room's recording facilities.
CCTV footage is stored for a maximum of 28 days, unless an incident, investigation, claim, legal proceeding or lawful request from an authorised body occurs. In such cases, only relevant footage will be stored for longer, only for as long as it is necessary for its resolution.
Access to camera footage is restricted to authorised persons from the Record Room and, where necessary, engaged service providers or competent authorities. Access shall only take place for the purposes mentioned in this article.
The processing of personal data, including booking data, payment data, contact details, account data, camera footage, and technical data, is further described in Record Room's privacy statement. The privacy statement is not a general term and condition, but it is important for user information.
Users who take the trouble to read the terms and conditions so thoroughly are entitled to a 5% discount using the code ‘avw’ – well done!
Record Room may use external suppliers for, among other things, payments, bookings, access control, cloud storage, video editing, email, website hosting, and security. Where necessary, Record Room will enter into appropriate processor agreements or other privacy agreements with these parties.
Record Room can offer studio credit in the form of packages, strip cards, credits, or other prepaid balances.
Studio balance is valid for up to 12 months after the purchase date, unless a different validity is stated at the time of purchase.
Unused studio credit will expire automatically at the end of its validity period, unless Record Room decides otherwise out of consideration or mandatory law dictates otherwise.
The studio balance is non-refundable after the expiry of the statutory cooling-off period, except to the extent that mandatory law dictates otherwise or Record Room confirms otherwise in writing.
For consumers, the right of withdrawal as stipulated in Article 5 applies. Hours already used, booked date-specific sessions and delivered services will be settled proportionally upon withdrawal.
Studio credit is personal or account-specific and non-transferable to third parties without prior written consent from Record Room.
When booking, the user can choose to pay with studio credit, provided sufficient credit is available. The same cancellation, no-show and usage rules apply to such bookings as to regular bookings.
If a session paid for with studio credit is cancelled in time according to Article 4, the hours will be returned to the studio credit.
If Record Room decides to permanently discontinue the platform, a venue, or a studio balance product, the user will be given a reasonable opportunity to use any remaining studio balance. If use is not reasonably possible, Record Room may refund the unused portion on a pro-rata basis.
Individual bookings and studio credit are paid in advance via the payment methods offered.
A booking or purchase is only confirmed after the payment has been successfully completed and confirmed by Record Room.
If a payment fails, is cancelled, reversed, charged back or otherwise rescinded, Record Room may block the booking, access code, digital key, delivery of recordings or studio credit until full payment has been received.
All prices on the site are listed exclusive of VAT, unless clearly indicated otherwise.
The 21% tax rate applies to all services.
Any costs for payment methods will only be charged to the extent permitted by law and will be clearly stated in advance.
Record Room shall not be liable for damages or costs if performance is temporarily or permanently impossible due to circumstances beyond its reasonable control.
This includes, but is not limited to, power outages, internet outages, fire, water damage, building malfunctions, government measures, outages on external platforms, outages with suppliers, security incidents, on-site emergencies, extreme weather conditions, strikes or other circumstances that Record Room cannot reasonably prevent.
In case of force majeure, Record Room will, where reasonably possible, offer a replacement session. If replacement is not reasonably possible, Record Room may refund the amount paid for the session.
Record Room may change these terms and conditions from time to time, for example, due to legislation or regulation, changes in service provision, new features, security measures, privacy requirements, or operational adjustments.
Substantial changes will be announced at least 30 days before they come into effect via e-mail, the platform or the user's account, unless an earlier change is necessary due to legislation, safety, abuse prevention or urgent operational reasons.
Substantial changes do not apply to bookings already confirmed, unless the change is necessary due to legislation, safety, abuse prevention, or operational necessity.
In the event of material adverse changes to an existing studio balance, the user will be given the opportunity to use the remaining balance within a reasonable timeframe. If this is not reasonably possible, Record Room may refund the unused portion on a pro-rata basis.
Complaints can be submitted via [email protected] or via the contact method stated on the website or in the account.
Record Room will respond to complaints within 5 working days and aims to resolve complaints as quickly as possible and in good consultation.
Failures during a session must be reported as quickly as possible via the tablet, help button, chat, phone number, or other support method offered by Record Room. If a failure is not reported during the session, it may affect the ability to diagnose or rectify the problem.
These conditions and all agreements with Record Room are subject to Dutch law.
The parties attempt to resolve disputes through mutual consultation first.
Disputes that are not resolved by mutual agreement shall be submitted to the competent court in the district of Amsterdam, insofar as this is legally permissible.
If the user is a consumer, they retain the right to submit the dispute to the court that has jurisdiction according to the law.
If any provision of these terms and conditions is found to be void, voidable or otherwise unenforceable, the remaining provisions shall remain in full force and effect. The parties shall, where necessary, replace the affected provision with a valid provision that most closely approximates the intention of the original provision.
Record Room may transfer its rights and obligations from agreements with users to a third party, for example in the event of a sale, merger, acquisition, restructuring or transfer of business. The user will be informed of this in good time, to the extent reasonably possible.
The user may not assign their rights and obligations under the agreement to third parties without the prior written consent of Record Room.
These terms and conditions have been drafted in Dutch. If translations are available, the Dutch text shall prevail.
